Types of Trademarks

Post by Maksudasm »

Trademarks can have different shapes, colors and meanings, but they should be easy to identify which company produced a particular product or service. To register, you will need to provide a clear description of it.

Trademarks are divided into several types: verbal, pictorial, sound, olfactory, volumetric, changing, light, holographic, positional and combined.

For each type, you can choose an example from real life, for example, the trademark of the company NIKE is a combined one, and NOKIA is a verbal one.

Let's take a closer look mom database at each type of designation. Let's start with the fact that when registering, you need to follow the rules for the execution, sending and review of documents, including for the description of your trademark.

A verbal trademark is a designation in the form of a lexeme, phrase or sentence. If it has no semantic meaning, then it is worth indicating the method of forming the sign. This applies to abbreviations, combinations of the initial syllables of several words, made-up words, etc. When a trademark is created in a foreign language or the language of the peoples of the Russian Federation, a Russian transliteration or translation must be added to it (if there is a semantic meaning).

A volumetric TZ is a three-dimensional object, a figure, it can be presented as a set of lines and figures in space. Most often, such a designation is used as a form of goods/packaging or as a separate item. The application is submitted with a full view of the sign and its projections.

The sound specification is provided in the form of a musical notation or a frequency diagram of the melody on a digital medium. The duration of the sound recording with a sound example should not exceed 10 bars (musical phrase), and in the case where the recording consists of noises of objects or living beings, no more than 30 seconds.

A pictorial design is a flat drawing of an object, natural object or creature, a set of lines, spots or figures in a certain combination.

Types of Trademarks

The figurative trademark is attached to the application on a square, thick sheet of paper with a side of 8 centimeters. If the sign is used on a label, it is also attached. For colorful images, the selected color scheme is used.

The positional designation indicates the position of the mark on the product for which it is registered. The product must be presented schematically, and the mark as a full-fledged image.

The light or changing TZ is reproduced on the video recording. But it can be imagined as several consecutive frames, replacing each other as the image changes.

The holographic sign is provided in the form of three images from different angles at an angle of 90 degrees or slightly above/below the perpendicular direction.

Olfactory or taste designation is registered very rarely, however, such a possibility also exists. The applicant must describe these qualities of the product in his own words, and also indicate its exact characteristics: composition, formula of the chemical compound of the substance, source of taste/smell of the product and other data.

Applicants can find an exact description and examples of trademarks for registration in the Rospatent manual.
